Welcome to lightkeeper.cloud. These Terms of Service (hereinafter referred to as "Terms") govern your access to and use of the service.

By using our service, you agree to these Terms. If you do not agree with any part of these Terms, please discontinue use of the site.

1. General Provisions

1.1. The lightkeeper.cloud service is provided by an individual entrepreneur (self-employed), registered in Portugal (Recibos Verdes).

1.2. The service provides tools for monitoring and analyzing website performance using Google Lighthouse technology.

2. Accounts and Security

2.1. Access to the full functionality of the service requires registration using an Email address.

2.2. You are solely responsible for maintaining the confidentiality of your account credentials and for any activities that occur under your account.

2.3. We reserve the right to suspend or terminate your account in case of suspected unauthorized access or violation of these Terms.

3. Service Usage and Technical Limitations

3.1. Provision "As Is": The service is provided on an "as is" and "as available" basis. We do not guarantee 100% service availability (Uptime) or the absence of technical errors.

3.2. Technical Factors: You acknowledge that tests are launched via cloud infrastructure (AWS Fargate). Network conditions, server geography, and infrastructure load may affect measurement results.

3.3. Guarantee of Rights to Resources: By using the service to analyze a specific URL, you guarantee that you are the owner of the resource or have explicit permission from the owner to conduct automated testing.

3.4. Prohibited Actions: You agree not to use the service to:

  • Intentionally create excessive load on third-party websites (DDoS);
  • Attempt to decompile or reverse-engineer the platform;
  • Use the service in ways that violate the laws of Portugal or the EU.

3.5. Data Retention: The retention period for reports is determined by your subscription plan. We reserve the right to delete data after this period expires without prior notice.

4. Professional Disclaimer

4.1. Lighthouse results are for informational purposes only. They do not constitute professional advice on SEO, security, or web development.

4.2. We do not guarantee that following the recommendations in the reports will lead to improved search engine rankings, increased loading speeds for end users, or compliance with legal standards (such as WCAG accessibility).

5. Payments, Taxes, and Subscriptions

5.1. Payment Processing: All payments are processed through Stripe. We do not store your credit card information.

5.2. Accepted Payment Methods: We accept payments via major credit and debit cards (Visa, Mastercard, American Express) and other payment methods provided through the Stripe secure gateway.

5.3. Delivery Policy: Access to the lightkeeper.cloud SaaS platform and its features is provided immediately upon successful processing of the payment. All reports and performance monitoring tools are delivered digitally via the user dashboard. No physical shipping is involved.

5.4. Taxes: You are responsible for paying all applicable taxes in your jurisdiction. Prices may or may not include VAT (IVA) depending on your location and tax status.

5.5. Changes to Terms: We reserve the right to change service costs and plan limits by notifying you via Email 30 days in advance.

5.6. Subscription Cancellation: You may cancel your subscription at any time through your Account Settings. Upon cancellation, you will retain access to the paid features until the end of your current billing cycle.

5.7. Refunds: Since the service provides immediate digital access and consumes infrastructure resources upon use, we generally do not offer refunds for partial subscription periods. However, if you experience technical issues that prevent you from using the service, please contact us at denys@lightkeeper.cloud within 14 days of the transaction for a case-by-case review.

6. Limitation of Liability and Indemnification

6.1. Maximum Liability: To the maximum extent permitted by law, the aggregate liability of the service owner to the user for any claims is limited to the amount actually paid by the user for the service during the 12 months preceding the claim.

6.2. Indirect Damages: We are not liable for any loss of profit, data, or business reputation.

6.3. Third-Party Failures: We are not responsible for service interruptions caused by failures of providers such as AWS, Vercel, Supabase, Stripe, or other critical internet nodes.

6.4. Indemnification: You agree to hold the service owner harmless and indemnify them against all damages (including legal fees) arising from third-party claims related to your use of the service or your violation of these Terms.

7. Force Majeure

7.1. We are exempt from liability for failure to perform obligations in the event of circumstances beyond our control (force majeure), including but not limited to: natural disasters, wars, cyberattacks on infrastructure, power outages, or global failures of cloud services.

8. Governing Law and Dispute Resolution

8.1. These Terms are governed by the laws of Portugal.

8.2. All disputes shall be resolved in the competent courts of Lisbon (or the place of registration of the service owner).
